The US Waiver Application process is not simple. And after completing dozens upon dozens of applications, our lawyers and paralegals have put together a comprehensive list of the most common mistakes they see when it comes to US Waiver Applications. So without further ado, here are the 6 most common mistakes when it comes to US Waiver Applications.<\/p>\n

Providing Inaccurate Information<\/h3>\n

When you have your consult with your lawyer to prepare your application, your lawyer will likely ask you more questions than you expected to answer. Your lawyer might ask you about times in your life that you are not super comfortable talking about. While it makes sense that some of these conversations are difficult to have, rest assured that the reason your lawyer is asking you these questions is to increase your likelihood of obtaining your waiver. It is vitally important that you are not only honest in the assessment part of your case but also that you do not leave out any information. While you may believe that certain aspects of your past are not relevant to your case, be sure to provide your lawyer with as much information as possible and let him\/her deicide what information is relevant to your application.<\/p>\n

Record Suspension (Pardon) Does Not Equal A Waiver.<\/h3>\n

What is a Record Suspension (pardon)? According to the Canadian Government, \u201ca record suspension allows people who were convicted of a criminal offence, but have completed their sentence and demonstrated that they are law-abiding citizens for a prescribed number of years, to have their criminal record kept separate and apart from other criminal records.\u201d<\/a><\/p>\n

A US Entry Waiver is needed if you have been deemed inadmissible by the US Government. This doesn\u2019t necessarily mean that you have a criminal record. There are a number of reasons why one can be deemed as inadmissible<\/em>. According to USCIS, here are 8 reasons for inadmissibility.<\/p>\n

It is important to know that just because you were pardoned, that does not mean that you don\u2019t need a US Entry Waiver.<\/p>\n

Proper RCMP Report<\/h3>\n

There are quite a few RCMP Reports that one can obtain. For the purpose of your US Entry Waiver, be sure to asking for the following;<\/p>\n

Application Type:<\/strong> Criminal Record check for Personal Use (This used to be called \u201cPrivacy Act Request\u201d and changed to \u201cCriminal Record Check for Personal Use\u201d in 2020).<\/p>\n

It Is Not A Quick 2-Week Process<\/h3>\n

There is a common misconception that US Entry Waivers are a rather quick process. While the work itself can be done in a few short weeks, the processing times today are about 6 months long. So if you are planning on traveling for Christmas, you are likely too late to get your waiver in time. Do not wait until weeks before you need to travel to start your application process.<\/p>\n

You Must Renew<\/h3>\n

US Entry Waivers can be granted in 1 year increments, 3 year increments or 5 year increments. Once your application has been approved, it is important to note that if you want to continue to travel to the US after your US Entry Waiver has expired, you must renew your application. US Entry Waivers are not granted for an indefinite period of time.<\/p>\n

Don\u2019t Overstay<\/a><\/h3>\n

For many snowbirds that like to head down south to Florida for the colder months, you\u2019ll typically have about 6 months to stay. However, it\u2019s crucial to note that an overstay can lead to inadmissibility. Be sure to track your days and abide but all the legal immigration requirements.<\/p>\n
