(Ho, 22 I&amp;N Dec. 206 (AAO) 1998.)<\/p>\n<p>Dans <em>In re Ho<\/em>, le b\u00e9n\u00e9ficiaire cherchait un EB-5 bas\u00e9 sur un investissement dans King\u2019s Wheel Corp. Une soci\u00e9t\u00e9 californienne (bas\u00e9e \u00e0 Compton) qui importe des roues d\u2019automobile en acier et en aluminium. Le b\u00e9n\u00e9ficiaire a transf\u00e9r\u00e9 plus de 500 000 $ sur le compte commercial de la soci\u00e9t\u00e9 en \u00e9change de la moiti\u00e9 des actions autoris\u00e9es de la soci\u00e9t\u00e9. Le plan d'entreprise indiquait que les ventes commenceraient dans trois \u00e0 six mois \u00e0 compter de la date de soumission de la p\u00e9tition et qu'en plus des deux employ\u00e9s d\u00e9j\u00e0 embauch\u00e9s, au moins huit autres employ\u00e9s devaient \u00eatre embauch\u00e9s dans les 12 mois. Deux formulaires I-9 ont \u00e9t\u00e9 soumis comme preuve que les deux embauches ont \u00e9t\u00e9 effectu\u00e9es. Mais aucun bulletin de paie ou registre de paie n'a \u00e9t\u00e9 fourni, et il n'a pas \u00e9t\u00e9 expliqu\u00e9 quels postes les employ\u00e9s occupaient ou s'ils \u00e9taient \u00e0 temps plein ou \u00e0 temps partiel.<\/p>\n<p>Un investissement EB-5 doit cr\u00e9er au moins 10 emplois \u00e0 temps plein. Si les employ\u00e9s n\u2019ont pas encore \u00e9t\u00e9 embauch\u00e9s au moment de la pr\u00e9sentation de la p\u00e9tition, vous devez fournir un exemplaire du plan commercial complet indiquant que, en raison de la nature et de la taille projet\u00e9e de la nouvelle entreprise commerciale, la soci\u00e9t\u00e9 devra embaucher 10 personnes. employ\u00e9s au cours des deux prochaines ann\u00e9es.<\/p>\n<p>Pour \u00eatre \u00abcomplet\u00bb, un plan d'entreprise doit \u00eatre suffisamment d\u00e9taill\u00e9 pour permettre des d\u00e9ductions raisonnables quant au potentiel de cr\u00e9ation d'emplois. Un plan d'entreprise complet, tel que pr\u00e9vu par la r\u00e9glementation, devrait contenir au minimum:<\/p>\n<ul>\n<li>Une description de l'entreprise, de ses produits et \/ ou services et de ses objectifs;<\/li>\n<li>Une analyse de march\u00e9, comprenant le nom des entreprises concurrentes et leurs forces et faiblesses relatives, une comparaison des produits et des structures de prix de la concurrence et une description du march\u00e9 cible \/ des clients potentiels de la nouvelle entreprise commerciale;<\/li>\n<li>Une liste des permis et licences requis obtenus;<\/li>\n<li>Une description du processus de fabrication ou de production, des mat\u00e9riaux requis et des sources d'approvisionnement (le cas \u00e9ch\u00e9ant);<\/li>\n<li>Des d\u00e9tails sur tous les contrats conclus pour la fourniture de mat\u00e9riaux et \/ ou la distribution de produits;<\/li>\n<li>Une discussion sur la strat\u00e9gie marketing de l'entreprise, y compris la tarification, la publicit\u00e9 et le service;<\/li>\n<li>La structure organisationnelle de l\u2019entreprise et l\u2019exp\u00e9rience de son personnel.
