Visa H-1B - Visa américain pour les professionnels spécialisés
La Visa H-1B is the best-known US work visa, used by employers to hire foreign professionals in specialty occupations. For Canadians, it’s worth understanding, but it’s often not the fastest route, because it’s capped and awarded by lottery. This page explains how the H-1B works and shows the cap-free alternatives that many Canadians use instead.
Silver Immigration helps Canadian professionals and their US employers choose the right work-visa strategy.
What Is the H-1B Visa?
The H-1B lets a US employer hire a foreign worker in a métier de spécialité, a role that normally requires at least a bachelor’s degree in a specific field. It’s open to all nationalities, is initially granted for three years (extendable to six), and is a common route toward a green card.
The H-1B Lottery and Annual Cap
Demand far exceeds supply. Each year there’s a numerical cap and, because registrations exceed it, a random lottery decides who can file. That means even a qualified candidate with a job offer may not get an H-1B in a given year, a key reason Canadians often prefer alternatives.
H-1B Visa Requirements
- Une US job offer in a specialty occupation.
- Une bachelor’s degree or higher (or equivalent) in a related field.
- An employer willing to file and to meet prevailing-wage and labor-condition requirements.
H-1B for Canadians: Why the TN or L-1 Is Often Better
Canadians have options most nationalities don’t:
- Visa TN: no cap, no lottery, often same-day at the border, renewable indefinitely.
- Visa L-1: for intracompany transfers, with a direct green-card path for managers.
- Visa O-1: for those at the top of their field, no cap.
If your occupation fits the TN list, that’s usually the faster path. If not, the H-1B or L-1 may be right. We help you decide.
Questions fréquemment posées
Can Canadians get an H-1B visa?
Yes, Canadians are eligible, but they’re subject to the same cap and lottery as everyone else. Many use the cap-free TN instead.
What’s the difference between the TN and H-1B?
The TN is limited to listed professions but has no cap, no lottery, and faster processing. The H-1B covers more occupations but is lottery-based. See our Visa TN page.
How long does the H-1B last?
Three years initially, extendable to a maximum of six, with further extensions possible in green-card scenarios.
